I'm wanting to buy a burger van in a lay by the owner is thinking of selling it to me but he seems to the think the council wouldn't let me take this over does anyone know if this is possible just to take over thanks.

Burger van pitch

Hi can anyone help me with a dilemma I signed a contract with someone for a trailer AND PITCH. I've paid the money over and now found that it's a council pitch. Can they charge for a council pitch, if not, is this a breach of contract. As on contract it clearly states and signed by both parties TRAILER AND PITCH. Hope someone can help many thanks

Hi Stacy,

Yes do approach your local council to see if they issue a street trading license, some do and some don’t. They will also be able to tell you if they have any opportunities for catering units, although to be honest there is normally a queue of people waiting, but it’s still worth asking. From there it’s just a matter of searching for a pitch within your local area i.e business parks, ind.est, private land etc.

what qualifications do I need?

Hi I just wanted to no What qualifications and certificates do I need to manage and run a food van? And when i'v passed everything would I need to get in touch with Manchester City Council to see about getting a traders licence or a street trading licence? I have not got a clue where to start can you please help me thank.

Hi Loppy,

The seller is probably telling you the truth, especially if it’s a council owned pitch. This kind of pitch has a long waiting list and is not transferable to other people. If you were a family member then a transfer maybe possible, but you would have to speak to the council that is responsible for the pitch.

You can also contact the council yourself and find out the specifics of the pitch, which is something I would always encourage.

It’s good of the owner to mention this as some unscrupulous pitch owner would try and sell the pitch for a premium price only for you to be told that the pitch was never allowed to be sold on to another party. A few people have been caught this way and have lost a lot of money. So whatever you decide, make sure when buying any pitch to do all necessary checks.
